Terms of service
Last updated: October 27, 2026
About these terms
These terms are an agreement between you and [DEVELOPER LEGAL NAME] ("we", "us"), the developer of Vitey. They apply together with Apple's Licensed Application End User License Agreement (the "Apple EULA"), which covers your licence to use apps from the App Store. These terms add to the Apple EULA; if the two conflict, the Apple EULA applies. By using Vitey you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Vitey.
Who can use Vitey
You must be at least 13 years old to use Vitey. If you're under 18, or under the age of majority where you live, use Vitey only with the permission of a parent or guardian, who agrees to these terms for you. Setup asks for your date of birth and doesn't continue for anyone younger than 13.
Not medical advice
Vitey is for general wellness and fitness. It is not a medical device and doesn't diagnose, treat, cure or prevent any disease or condition. Scores, estimates, targets, plans and tips (for example readiness, stress, training load, sleep debt, calorie and protein targets, and patterns) are general information based on the data available, which can be incomplete or inaccurate. Readings from Apple Watch and other devices can be wrong. Don't use Vitey to make medical decisions; talk to a doctor or other qualified professional first, especially if you are pregnant, have a health condition, an injury or an eating disorder, or take medication. If you think you may have a medical emergency, call your local emergency number straight away.
Exercise and nutrition safety
Physical activity and changes to how you eat carry risks, including injury. Start gradually, warm up, use equipment safely, and stop if you feel pain, dizziness, chest discomfort or shortness of breath. Calorie and nutrition information comes from you and from public databases and may not be exact. You decide whether to follow any plan or suggestion, and you're responsible for those decisions.
Plans and automatically written text
Workout plans, insights and tips are generated automatically by rules in the app and, on supported iPhones, worded by Apple's on-device Apple Intelligence. They are not written or checked by a person, can contain mistakes, and are not tailored to you the way a coach or clinician would. Vitey's safety rules (for example easier plans when your profile mentions a health condition or pregnancy) reduce risk but can't remove it.
Your data and privacy
Vitey has no account. What you enter and what Vitey reads from Apple Health stays on your device, except the limited requests described in the Privacy Policy and the Consumer Health Data Privacy Policy, which explain what is used, how, and how to delete it. Data you enter is yours.
Your licence and fair use
We license Vitey to you for personal, non-commercial use on Apple devices you own or control, as set out in the Apple EULA. Please don't copy, modify, resell, reverse engineer or redistribute Vitey, try to break or overload it or the services it connects to, use it to break any law, or use it in a way that could harm you or others. We may stop your use if you seriously or repeatedly break these terms.
Third-party services and content
Vitey works with Apple Health and Apple services, and gets weather, food, map and place information from third parties (such as Open-Meteo, Open Food Facts, OpenStreetMap and Apple Maps). That information is provided as is, can be incomplete or out of date, and is subject to those providers' own terms. Map data is © OpenStreetMap contributors, available under the Open Database License.
Intellectual property
Vitey, including its name, logo, design, drawings, text and code, belongs to us or our licensors and is protected by law. These terms don't give you any rights to them other than the licence above. If you send us ideas or feedback, we may use them without owing you anything.
Price and future purchases
Vitey is currently free. If we offer paid features in the future, the price and what you get will be shown before you buy. Purchases are made through Apple and are governed by Apple's terms, including its refund policies.
Changes to Vitey and to these terms
We may update, change, pause or stop Vitey or any feature at any time. We may update these terms; the new version will show a new date in the app, and if a change is important we'll ask you to agree again before you keep using Vitey.
Disclaimers
To the extent the law allows, Vitey is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don't promise that Vitey will be uninterrupted, error free or that it will achieve any particular health or fitness result.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, injury or loss arising from your use of Vitey or from relying on anything it shows. Our total liability for any claim relating to Vitey is limited to the greater of the amount you paid for Vitey in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not apply to you, and nothing in these terms limits rights you have under the consumer laws where you live.
Apple
These terms are between you and us, not Apple. Apple is not responsible for Vitey or its content, and has no obligation to provide maintenance or support for it. If Vitey fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation for Vitey. We, not Apple, are responsible for handling any claims about Vitey, including product liability claims, claims that Vitey doesn't meet legal or regulatory requirements, consumer protection or privacy claims, and claims that Vitey infringes someone's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
Governing law and disputes
These terms are governed by the laws of the State of [STATE], USA, without regard to its conflict-of-law rules. Disputes will be handled by the state or federal courts located in [STATE], unless the law where you live gives you the right to bring a claim in your local courts, in which case you may do so. If you live in the European Union, the United Kingdom or another country with mandatory consumer protections, you keep those protections.
Ending use
You can stop using Vitey at any time: delete your data in Profile › Delete data and start over, then delete the app. Because there's no account, there's nothing else to close. The sections on medical advice, intellectual property, disclaimers, liability, Apple and disputes continue to apply after you stop using Vitey.
General
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms, we haven't given up the right to do so later. These terms, the Apple EULA and our privacy policies are the whole agreement between you and us about Vitey.
